Background

The New Zealand Holidays Act was established to promote a healthy work/life balance for all employees working in New Zealand. It sets out how employers should pay employees for various leave types and the calculations used for these payments. 


The Act is a complex piece of legislation and many New Zealand businesses have found it difficult to apply. Following audits led by New Zealand’s Labour Inspectorate in 2016, it was found that many employers, including Beca, had calculated leave incorrectly.

With support from independent advisors Deloitte, we’ve recalculated leave payments from October 2010 to August 2024 and have identified instances where leave has not been calculated correctly.  


Beca will be making remediation payments to current and former employees who are eligible. We’re required to pass on all monies owed, no matter how small.

If you are eligible for a remediation payment, we will contact you via email or post, using your last-known details. If you haven’t heard from us, and believe you may be eligible, contact us below.

Once contacted, you will need to register your payment details in our Remediation Portal. A link to this portal will be included in your email or letter.  You’ll need to give us some more information, so we confirm your identity and process your payment.

Frequently asked questions

The Labour Inspectorate expects employers to remediate payments owed to employees at least six years back from the date of identified non-compliance. Beca has reviewed calculations of leave payments between October 2010 and August 2024.  

The amounts will vary depending on your individual circumstances, including your earning history and leave patterns, which are unique to each person. We are required to make remediation payments to all who were affected, no matter how small the value is.

We require the following information to validate your details and make sure we pay you safely and securely: 
Contact information, Reference number (this can be found on your remediation letter), New Zealand bank account and proof of bank account, Proof of identity (passport or driver license), IRD number, KiwiSaver contribution amount or savings suspension letter, and Tax code.

As part of registering your details using our online portal you will need to confirm your tax code. Your payment will be taxed as a lump sum payment and reported to IRD as income in the current tax year.  Further information about lump sum payments can be found in this IRD factsheet

We encourage you to contact the relevant organisations for advice on whether your remediation payment may impact any Child Support, Working for Families Tax Credits or other benefits or deductions. You can contact the IRD directly on 0800 775 247.

If you are currently enrolled in KiwiSaver, contributions will be automatically deducted from your remediation payment, and we will also make the employer contribution. We will ask you to confirm your KiwiSaver deduction rate. If you are on a KiwiSaver savings suspension, you will need to provide a copy of your suspension notice.

We will attempt to contact former employees at your last known email or physical address we have on file. If you have not heard from us but think you may be owed a payment you can contact us at info@holidaysactreview.beca.com

No, there will be no interest paid on remediation payments.

After registering your details, please allow eight weeks for payment processing, provided your information can be validated.

The IRD states that any remediation payment must be reported as income in the current tax year.

Our recommendation is to use a New Zealand bank account, as offshore bank accounts are more complex to process. If you are unable to provide a New Zealand bank account, please get in touch with us at info@holidaysactreview.beca.com

If you provide a student loan tax code, student loan repayments will be deducted from your remediation payment.
